Trump Attorneys Are Referred To Judicial Disciplinary Action From Spreading Election Misinformation

Photo: Los Angeles Times

Spreading misinformation is not against the law if the spreader is a private citizen who is operating on social media.  Although, the rules of spreading misinformation changes when that private citizen is also an officer of the Judicial system (i.e., a lawyer).  Back in November of 2020, an army of Trump lawyers were touting across the states that voter fraud had been occuring. On a large scale.  Judgment after judgment came down from courts across the United States disproving allegations of voter fraud.

Now, in one of those courts, a judge has gone further and recommended disciplinary action for lawyers who have spread misinformation about voter fraud.  In the excerpt below from MSNBC's Rachel Maddow Show, the rulings are highlighted along with the language which could result in disciplinary actions for the lawyers listed:

The lesson outlined in the video above is a take-away message for attorneys all around the United States.  Don't spread misinformation outside of a courtroom prior or after walking into a court of law and having a case thrown out (or dismissed) based on lack of evidence.  You are just wasting the public's time and the courts time too -- which is the publics time.  Hopefully, these lawyers will be disciplined for the misinformation that has helped further divide our country.

How Far Will Conservatives Go With Robocalls To Suppress Voter Turnout?

Photo: TechCrunch.com

How far will the opposing side go to suppress voter turnout?  How low will people go?  Pretty low.  Recently, news outlets have been circulating a story of 'Washington Operatives' that have been involved in smearing campaigns for former President Trump.  Now, the operatives find themselves in increasingly greater trouble.  Why?

Jack Burkman and Jacob Wohl are the operatives that are mentioned in numerous articles lately surrounding the breaking news.  The deeper that a person digs will find that one operative -- Jacob Wohl -- has been involved in numerous scandals or smear campaigns

The two operatives listed above were recently (as in the last Presidential Election) investigated by the FCC for their attempt through Robocalls in various states.  These robocalls were discriminatory and attempted to obstruct voter suppression.  The story was carried by MSNBC's Rachel Maddow's show, in the video below:

I guess that this is the new norm?  We should all be aware of these illegal efforts moving forward.  Look out for such scams.  Congress should look further into the illegal method of scamming voters.  In the meantime, the responsibility lies in the hands of the voters.  This is unfortunate given that our politicians cannot regulate the space

What Is Your Learned Talent? Undiscovered or Not?

Photo: SeeItLive.CO

Each of us has a special talent.  Although, some talents stand out more than others among us.  Below is a video interview of the 'World's Fastest Talking Man' - John Moschitta, Jr.-- check it out:

I bet the competition for announcers at the end of car commercials -- or any other commercials -- for disclaimer was not large.  Therefore, Mr. Moschitta might have had a wealth of speaking opportunities over the course of his lifetime.  As long as his voice did not give out.

Florida Doctors Walkout Of Hospital In Protest

Photo: MSNBC

As the workweek begins, Floridians are faced with doctors at a local hospital staging a 'walkout' in protest of patients arriving with COVID-19 who have not been vaccinated.  Yes, a doctor's duty is to heal any patient to the best of their ability.  Even if the patient chooses not to treat themselves to the best of their own ability.   Although, the denial of vaccination efficacy along with the rising numbers of COVID-19 cases among those who have not been vaccinated has caused problems.

What type of problems?

In Northern Texas, hospitals are completely out of 'child ICU beds'.  This means that if your child needs an ICU bed, that child might be deprived of an ICU bed because of a reckless choice made by another child's parents and relatives.

Over 75 doctors walked out of a Florida hospital this morning in protest.  Below is a video of an interview conducted with one of the doctors by MSNBC:

Get vaccinated please.  The science is present and shows that vaccinations work.

Can We Leave Afghanistan?

Photo: Politico

The people of Afghanistan are under a great deal of tragedy with American troops boarding planes and leaving behind a 20-year war.  News outlets are reporting the reality of Afghanistan citizens trying to board airplanes, sometimes illegally, resulting in an untimely death.  Against this backdrop, are the American populate asking the large question: "Why are we still in Afghanistan?"

Politicians have campaigned on the American troop population leaving behind a country that is still fragmented and coming back under siege by the Taliban forces.  The following questions come to mind over the current situation:

What did the American people expect to see after troops are leaving?

At what point in history has America ever withdrawal from a war environment successfully without leaving behind casualties?

Do Americans understand the true nature of war?

Are the news outlets appropriately conveying the seriousness of American occupation/nation-building in other countries?

What interests (natural resources) does Afghanistan have that are important to the economic interests of the United States?

Americans Expectation

What did the American people expect after a withdrawal of troops?   I remember the first time I saw a prisoner of war.  At first, I did not believe that the pilots captured and beaten up during the first Gulf War were 'prisoners of war.'  That is how ignorant I was at the time.

What reference point did I have to judge the current scene I was viewing on TV at the time?  I was too young to remember Vietnam.  The atrocities of that war have been compared to Afghanistan in recent times.  The comparison is weak.  Vietnam was much much more terrible.  To compare these two wars has been a big mistake.  Just take the video clip of Lawrence O'Donnell from MSNBC, giving astonishing (and distinguishing) statistics which highlight the historic Vietnam War in comparison:

What about the veterans who have been in that conflict?  What are there thoughts about a withdrawal?

A recent interview of an Army Lieutenant Matt Zeller by MSNBC, reveals a different take on President Biden's speech regarding the withdrawal of troops from Afghanistan:

Nation-Building?

How are nations built?  Does the United States decide the government that a country should have installed?  Surprisingly, yes we do.  To promote democracy.  In the video below, we hear from a veteran that our withdrawal from Afghanistan was the best course of action at the moment:

Opinions vary as do theories about our presence in other countries. The larger question is should American soldiers die for other country's benefit when the mission is not completely clear?

Should We Be There?

To answer the last question, look no further than a recent article on Forbes.com:

They’re all after a big prize. There’s the potential for copper, gold, Afghanistan holds an estimated 1.4 million tons of rare earth elements (REEs), minerals crucial for the production of renewable energy technology. This makes Afghanistan a prime target of investment for China, the current king of global REE supply chains. America needs rare earths, and China controls 90% of processing capacity.

Chinese Ministry of Foreign Affairs spokeswoman Hua Chunying stated on Monday that Beijing will pursue a constructive role in establishing “peace and reconstruction” in Afghanistan. Russia – for its part – has ordered only a partial evacuation of its Kabul embassy staff, according to Putin’s special representative to Afghanistan: “Our embassy will stay in contact with specially assigned representatives of the Taliban higher leadership to work out a permanent mechanism of ensuring safety of our embassy and continued communication.” While Moscow considers the Taliban a terrorist organization, its Foreign Ministry already said that the mullahs’ political liaison office is not one – much like the Trump and Biden Administrations did when they negotiated with the Taliban.

Rare earth elements that are vital to the operation of the devices (smartphones, tablets, etc.) that each of us heavily rely on each day.   While we as Americans form opinions about our presence in other countries around the world, we should also consider our dependence on products produced with resources coming from those respective countries.

In the meantime, why are the lawmakers (and regulations) not preparing the U.S. to be in a position of independence from our dependence on such natural resources?  Why are we not building processing plants to deal with our natural resources that are mined here in the U.S. and sent to China?  These ideas might seem to stray from the topic above, but in fact, are directly related to the topic of dependence on foreign countries for resources and technological development.

Voter Misinformation Campaign Comes Up Short Of Actual Evidence

Photo: Business Insider

Over time and history, misinformation has persisted throughout the world.  With the rise of social media through the development of technology, misinformation has spiraled out of control.  How to control the flow of misinformation remains a large challenge to lawmakers across the country.  Until they do so, examples such as the one promoted by Mike Lindell (of 'My Pillow') will continue.

One large example that has persisted since last November's election is a campaign waged by the CEO of 'My Pillow' -- Mike Lindell.  Mr. Lindell has maintained that a conspiracy exists of voter fraud that is fueled by opponents of former President Trump.  Conspiracies reach far-off countries like China along with others.  Conspiracies encompass the fraudulent voting machines used in the elections.  A video by CNN is shown below with an ongoing conspiracy by Mr. Lindell:

Of course, there is no evidence of voter fraud.  But Mike Lindell will hear none of that.  He has carried on about holding evidence that is non-disputable.  The only issue is that when pressed to produce the evidence, he is unable to do so.  The world does not operate on hear-say.  Evidence counts Mr. Lindell.  Either produce evidence or change your position.

Ralph Nader: Collapsing Federal Corporate Crime Enforcement

Photo: ProMarket

If Americans learned one large lesson during former President Trump's presidency, it is the fact that Congress let the American public down.  How?  By not doing their job and prosecuting corporations and corrupt individuals.  There are many.  Too many.  The laws and regulations created by Congress are meaningless, if not enforced.  Another large lesson learned was that a 'subpoena' from Congress is meaningless.  Nothing came of the 'subpoena' power by Congress.

Against this backdrop of disappointing efforts to take action by Congress, corporate corruptness still continues.  Iconic Activist Ralph Nader reminds us of the fact within his recent newsletter shown below:

Collapsing Federal Corporate Crime Enforcement

As the size and severity of the corporate crime wave surges, Congress is asleep at the switch. The mostly captive Capitol Hill Gang has sat on an antiquated federal criminal code, starved the budget of regulatory health, safety, and consumer/labor protection agencies, and let corporate crooks routinely get away with their crimes.

Despite constant exposés in the mainstream media – still only reporting the tip of the iceberg – neither members of Congress nor presidents from the Republican and Democratic parties have raised the banner of tough “law and order” to counter rampaging corporate crime.  Proposals to bring the laws up to date in their penalties and coverage to deter corporate lawbreaking are never a priority for Congress. When was the last time you heard a politician demand “corporate reform”?

Many people still remember how Wall Street, in its greed and power, collapsed the economy in 2008-2009, cost nine million jobs, shredded pension and mutual funds, and insisted on a multi-trillion-dollar bailout. In 2018 Public Citizen found during President Donald Trump’s first year in office, enforcement against corporate crime and wrongdoing plummeted from the final year of the Obama administration (See Corporate Impunity “Tough on Crime” Trump Is Weak on Corporate Crime and Wrongdoing).

None of the big boys and mid-sized big boys were ever prosecuted. Shortly thereafter polls showed 90 percent of Americans (conservatives and liberals) wanted to break up the big banks that were too big to fail. Conservative columnist, George Will, wrote that companies too big to fail should not exist.

But exist they do, and their marauding continues almost unabated. According to fraud expert, Harvard Professor Malcolm Sparrow, year after year, billing fraud and abuse accounts for at least 10% of healthcare expenses. That’s over $350 BILLION this year. Less than two percent is recovered by law enforcement.

As one prosecutor put it, no matter how complex the rip-offs are, no matter how silent or invisible is the violence (e.g., toxics, latent defects, dangerous pharmaceuticals hospital induced infections, etc.), it comes down to lying, cheating, and stealing.

Some corporate crimes are too big to be ignored. Here is a New York Times report: “Over the past two decades, more than 500,000 people in the United States have died from overdoses of prescription and illegal opioids …. Purdue [Pharma], widely believed to have helped ignite the problem by downplaying the addictive potential of OxyContin and aggressively marketing the drug with misleading campaigns, pleaded guilty to two separate investigations by the Justice Department.” The company escaped into bankruptcy. There are all kinds of lawsuits. The bottom line is that the proposed settlement let the Sackler family, mega-billionaire owners, paid out just a small chunk of their immense ill-begotten fortune. Criminal prosecutions of corporate wrongdoers and criminals are almost never pursued.

As the Times wrote: “Neither the company, nor the Sacklers, would admit to wrongdoing in connection with these [about to be settled] lawsuits,” brought by many state attorneys general and the Justice Department.

Welcome folks to the widespread phenomenon of corporate crimes without criminals. Also, the settlement, expected to be signed off by the judge, would release the Sacklers and their company from any personal civil liability. The several billions of dollars that will be paid without any personal prosecutions is the way corporate attorneys succeed in monetizing murder or manslaughter as just a deductible cost of doing business. No clients going to jail. (See Rena Steinzor’s book, Why Not Jail? Industrial Catastrophes, Corporate Malfeasance, and Government Inaction, 2014).

Boeing’s attorneys are also pushing for their strategy of immunity under existing litigation. They got the Trump Justice Department, (DOJ), days before Trump left office in January 2020, to conclude a corrupt, sweetheart “deferred prosecution” settlement (See Corporate Crime Reporter: Lead Boeing Prosecutor Joins Boeing Corporate Criminal Defense Firm Kirkland & Ellis). Though there was a grand jury in operation, there were no indictments or other charges against any of the culpable company bosses who made the decisions that led to the loss of 346 lives in two 737 MAX crashes. Boeing paid a measly $2.5 billion mostly deductible dollars.

To make the stench worse, DOJ’s Attorney General William Barr chose a faraway federal court in Fort Worth, TX, known for its corporatist judge, with a right-wing prosecutor, who after cutting the deal, quit and took a job with Kirkland Ellis – Boeing’s criminal defense law firm.

In the civil lawsuits against Boeing, brought by the aggrieved families, Perkins Coie, Boeing’s law firm, is going all out to avoid trials and settle all these cases through mediation, which, of course, excludes sworn testimony and primitive damages. The overriding goal is to assure that the culpable Boeing bosses and others are neither charged or put on the witness stand under oath in a public trial open to the media and citizenry. See why big corporate lawyers make so much money? They keep the prisons empty of corporate wrongdoers by having them be above the law.

Senator Richard Blumenthal (D-CT), now Chair of the Senate Judiciary Committee’s Constitution Subcommittee, has spoken out about the absence of any criminal penalties in numerous federal statutes such as the ones covering auto and aviation safety. In 2015 Senator Blumenthal introduced the S.2140 the “Hide No Harm Act” that would make it a crime for a corporate officer to knowingly conceal information about a corporate action or product that poses the danger of death or serious physical injury to consumers or workers. As a former longtime Attorney General of Connecticut, he decries weaknesses of existing federal criminal statutes and small budgets. He wants action. It is high time to hold historic hearings that go to the cause of the systemic derelictions of justice regarding corporate abuses. America, besieged by corporate crime, needs corporate crime laws that fit these crimes.

Urge full Judiciary Committee Chair Senator Richard Durbin (D-IL) to provide Senator Blumenthal the requisite staff and resources for this historic mission. Senator Durbin’s phone numbers are Washington D.C. office: 202-224-2152 / Chicago office: 312-353-4952.

It is time for Congress to act and hold these corporations and heads of corporations accountable for the corruptness that pervades the market.

Florida Covid-19 Cases Surge, Governor DeSantis Gives Parents Of School Children A Break From Mask Wearing

Photo: NPR

Currently, a sizeable portion of U.S. residents agrees that wearing a mask reduces the spread of COVID-19.  With that being said, a second surge is occurring in geographical areas where mask mandates are being challenged.  Why someone would challenge a mask mandate?  I don't know.  My own brother challenges a mask mandate too.   Which I believe is not the right way to proceed.  But he is free to believe whatever he feels necessary.

Children return to schools across the nation over the next week or two.  With a mixed message on mask mandates, COVID-19 rates are going to increase.  What will follow?  Guess.  I would imagine more shutdowns.  Yes, folks.  Give people freedom from wearing masks that have been vaccinated and what happens?   The people who have been vaccinated still wear masks while those who have not been vaccinated proceed to take off those masks.  Amazing.

That is exactly what the Governor of Florida is doing.  As school opens up today, Governor Rick DeSantis is offering parents a way out from requiring their children to wear masks while in class.  This news comes at a time when children under 12 are still not vaccinated.  Why would I let my child attend class if choose to let their children not wear masks?

In the video below from CNN, a Pediatric Physician is interviewed from a hospital in Texas.  Another state has a high rate of residents challenging mask mandates.  Listen to the interview and think about what the physician is saying:

After watching the video, why would anyone challenge a mask mandate?

Below is a list of previous blog posts over the last year discussing the efficacy of mask-wearing in relation to the spread of COVID-19.  Read and think about what the data shows.  Stay tuned.

Nurses Have Patients In Denial Of COVID-19 Diagnosis Up Until Intubation

Photo:  MendWell

Hospitals across the country (USA) are filled with patients still in denial of a COVID-19 diagnosis.  Nearly a year and a half into the pandemic, certain patients are not able to believe that symptoms of a common cold are indeed COVID-19.  Even up until the point where medical intervention is necessary to keep the patient alive.  By this, the procedure of opening up an airway with a tube to assist the patient to breathe.

How crazy is this?

Some patients would rather believe that they are dying of cancer than of COVID-19?

In the video below by CNN, patients are interviewed along with nurses.  From the patient's standpoint, some are disappointed that they did not get the vaccination earlier.  Whereas, from the nurse's standpoint, denial is crazy among certain patient populations - which is astounding:

Alabama COVID-19 Cases Are Rising

Photo: WTVM

Alabama is a state which has not implemented a state-wide blanket mask mandate throughout the COVID-19 pandemic.  Why?  Ask the governor's office.  The press secretary stated that currently, the governor does not feel like a blanket mandate is warranted.  Oh well.  At the same time, COVID-19 cases are on the rise in large parts of the state.

In a recent interview on MSNBC's Morning Joe, an Alabama physician was interviewed about the growing crises:

The terrible tragedy increases due to a governor's ignorance regarding scientific evidence.  What is wrong with our politicians?

Dr. Fauci Gives Updates On Mask Wearing During COVID-19

Photo: LA Times

As the mask mandate begins to be lifted across the United States of America, a different variant of COVID-19 makes its way through the entire population.  What does the new or delta variant of COVID-19 entail?  What is different about the delta variant?  Why is transmission increased with the delta variant?

A recent news interview with Dr. Fauci on MSNBC Morning Joe gives an update on the changing virus and mask mandates.  The update is worth watching:

There are two main take-away points from the video above:

1) More viral particles are found in vaccinated people (nasal pharonyx)

2) Possible development of new variant that is resistant to current vaccines

The first take-away point increases the rate of transmission among vaccinated people to non-vaccinated people.  The second applies to the simple fact that if a virus has a sufficient amount of time to replicate, a variant will arise which will be resistant to every vaccine available.  That could be dangerous.  For this reason alone, everybody should be willing to get vaccinated.  Go get vaccinated today.
